I disagree, and always have. It was clear to me, even back in high school. Now that I've been given tools for studying a thing out? I'm more convinced than ever. The eye-for-eye applied to the child as well. They HAD to wait and see. The scripture reads exactly that way: Exo 21:22 “When men strive together and hit a pregnant woman, so that her children come out, but there is no harm, the one who hit her shall surely be fined, as the woman's husband shall impose on him, and he shall pay as the judges determine.Well it's speaking primarily of the woman's well being. You also have to think about the fact that she could always birth another by a man who can impregnate her- the mortality rate of newborns were ridiculous back then and so you wouldnt kill a healthy man over a frankly expendable thing.
It's harsh- but it's also true.
When people have a preconceived notion, they are going to naturally interpret scripture in such a way.
Exo 21:23 But if there is harm, then you shall pay life for life,
Exo 21:24 eye for eye, tooth for tooth, hand for hand, foot for foot,
Exo 21:25 burn for burn, wound for wound, stripe for stripe.
Why? Because scripture makes it CLEAR this is the case of a "pregnant" woman. It is making a very specific point about the life of the unborn. Read it again, it is clear. -Lon
