Illinois School District Refuses to Allow Boy in Girls’ Locker Room, Defying Obama Administration

CHICAGO — A school district in the Chicago area is remaining steadfast in its refusal to allow a male student who identifies as female to change in the girls’ locker room despite an opinion from the U.S. Department of Education that the district is violating federal law.

According to reports, an unidentified high school student within Township High School District 211 requested to use the girls’ locker room nearly two years ago since the student asserts that they identify as female.

But the district declined, citing the privacy concerns of the other students. It in turn offered the student a private location to change, but the student rejected the accommodation. He then contacted the American Civil Liberties Union, which in turn filed a federal complaint with the Office of Civil Rights of the U.S. Department of Education.

“They are telling a student that she can’t be with her friends at school but has to be relegated to a separate place to dress. That’s just a horrible thing to do,” John Knight, director of ACLU Illinois’ LGBT program, told the Daily Herald.

The Department of Education responded by opining that the district had to permit the student to use the locker room of his choice due to Title IX requirements.

But the district continues to refuse, and recently went public with the matter to outline its viewpoint.

“After serious and lengthy consideration, the district will continue to provide private accommodations for transgender students to ensure a respectful school environment, and will not allow unrestricted access to its locker rooms as directed by OCR,” it announced in a press release this month.

The district said that it desired to “to protect the privacy rights of all students when changing clothes or showering before or after physical education and after-school activities, while also providing accommodations necessary to meet the unique needs of individual students.”

“We believe that we would be compromising other students’ privacy if we did this. We do not believe we are discriminating,” Superintendent Daniel Cates added to the Daily Herald. “They are asking us to have opposite-sex students in the same open area of the locker room and showers. We do not do that.”

The district acknowledges that litigation or enforcement action may result from its decision, including the loss of $6 million in federal funding.

“District 211 has provided individual accommodations in a manner that does not infringe on the privacy concerns of other students, and it will continue to do so,” it said in it its statement. “It is the district’s position that OCR’s unilateral mandate does not consider the best interests of all District 211 students and their families.”

The ACLU remarked that now the government has spoken, it could lay the groundwork for schools nationwide.

“Having a finding and analysis from the Department of Education specific to locker rooms will certainly have a national impact in terms of telling school districts around the country what they should be doing,” Knight said.

The Palatine Township School District 211 must allow a transgendered student to use girls' locker room, federal officials said.

Palatine Township High School District 211 has been cited by the U.S. Department of Education for discrimination for barring a transgender student from having full access to the girls locker room.

However, school district officials claim they have done nothing wrong.

In a letter written to the district on Monday, federal officials informed the district that they have 30 days to make changes.

"We are disappointed in findings," said Dan Cates, District 211 superintendent. "We do not agree with conclusion that we violated the law."

The ruling was sparked by a complaint by a transgendered student in one of the district's five high schools. The student was born a male, however, has identified as a female years before she entered the district.

Supt. Cates said the district has made several accommodations for her and other transgender students, including "changing names as requested, changing gender records, also provide access to bathrooms identified as gender."

Cates said the district drew the line when it came to the student's request for full access to the female locker room.

"She had to go down long hallway to the other bathroom, she noticed she was singled out, it didn't make her feel part of the team," Cates said.

The student, whose identity has not been made public, turned to the American Civil Liberties Union for help and filed a complaint with the Office of Civil Rights.

The district came up with a solution that it strongly believes is not discrimination -- asking the transgender student to use privacy curtains. Department of Education officials said without full access, the district has violated the student's civil rights.

"It really reflects a sense on the part of the Department of Education and the federal government to really take a strong stand in regards to discrimination," said ACLU spokesman Ed Yohka.

I cant wait to see how many children will no longer be taking pe, refusing to dress out, or better yet, are removed completely from the school.

I also wonder how long it will take before some boy pretends to be a tranny so he can have access to the naked girls in the locker room with showers. And how long before the school is sued for not protecting the other students.

It's incredible. It's hard enough for most high school girls to get undressed around other girls much less these "wanna be" girls.

The only reason this boy/girl is refusing to accept the school's offer is to create a stink so the law will be enforced. :down:

Its to force recognition as one who claims to be a "girl" to be seen as one even with his stuff hanging out, i guess. He has to be comfortable in his skin, even if he causes hundreds of others not to be.

Its twisted.

All I have to say i doubt it is happening in a school district where there are lots of those P stone nation members.

If its a federal thing, it will be happening at all public schools.

I know that. What I am saying is how do you think a little queer boy who wants to go into the girls bathroom will fair in a school dominated by the P Stone Nation?

They do not feel a need to obey government rules.

I conclude the girly boy most likely is not attending such a school/

I'd never heard of the P Stone Nation. What are they, something like a white supremacy group?

What the tread is referring to are those of a normal sex who wish they were the opposite sex.

What you are asking about are persons who are never with two complete sexes, rather they are without one complete sex; they also seldom desire to be other than the sex they are at birth.

What if the child is a hermaphrodite? Can you Image teen years are tough enough, but having both sets of genitals would be terribly confusing.

Wouldn't you think such one would prefer to have a private dressing area for privacy reasons like was offered and available for the transgender in the op?

Your chromosomes should determine what set of facilities you use.... not your outward appearance.

Indeed. Your genetic makeup designates what sex you are. Having genitals changed does not make you a different sex. You are what your genes/chromosomes make you, not your plastic surgeon.

I'm surprised that the school district doesn't claim it would be sexual assault on a minor, to have someone displaying male genitalia in the changing/shower room with minor females.

The school has objected to that in their right to privacy. The Obama administration doesn't care about things like that.
