Attorney: Officer who shot Terence Crutcher had 'auditory exclusion,' didn't hear other officer say he had Taser ready

The probable cause affidavit for her arrest states that another officer told Shelby he had a Taser ready to deploy before she shot Crutcher, who was unarmed, on Sept. 16. But her attorney told the Tulsa World on Friday that she never heard that comment, also not realizing other officers had arrived and were standing with her.

Scott Wood, who represents Shelby, said she experienced “auditory exclusion.” Wood described it as a phenomenon officers often experience in critical incidents that results in a temporary loss of hearing.

Because of that, Wood said, Shelby didn’t hear other officers arrive with their cars’ sirens activated or approach her. Nor did she hear Officer Tyler Turnbough tell her that he had his Taser ready because she was “totally focused” on Crutcher, he said.

“She doesn’t have any recollection of that at all,” Wood said.

if the result of the non-lethal force had been a medical emergency that caused his death (ala eric garner), would it still have been justifed?

It seems parents and teachers can do better on both sides, because blacks do not trust whites even more.

I can agree with that, with the caveat that there's a far greater historical basis for a lack of trust in the black community. Much of the mistrust in the white community is based on imagining what could happen, while in the black community it's based on knowing what did happen.

Been on that type of call/situation over 100x. You don't shoot for non-compliance. You shoot when UOF escalates. Not hard ... been in that situation 100x….communication, taser, pepper spray…whatever it takes to protect life first[.]




And noting that the first recommendation by the police chief is communication. It sure seems that communication was abandoned too soon.

How was he classified as a spammer? I'm just curious as to how that works. He made two posts yesterday afternoon, neither of which appeared to be spamming, so I'm wondering how a spammer is identified as one.
He made two normal posts then he made a post with a link to a page that was obvious spam. It got caught in the spam trap, so you didn't see it. Only mods see posts caught in the spam strap. When a member is banned as spammer all of their stuff is erased because they may have posted more spam other places on the board including PM boxes. It is simpler than having to manually remove the spam. It ensures all of the spam is removed from the forum. Nuff said.

Maybe because the population of this country is still overwhelmingly white.

Some readers of our editorial “The Truth of ‘Black Lives Matter’” took exception to the idea that black Americans are “disproportionately killed in encounters with the police.” One commenter pointed us to an article in The Washington Times describing an analysis by Peter Moskos, assistant professor at the John Jay College of Criminal Justice at the City University of New York. The analysis purports to show that white people are more likely than black people to be killed by the police.

It’s hard to get real data on this. The statistics Mr. Moskos uses are deeply flawed. He drew his conclusions from a website called killedbypolice.net, which tracks news reports of fatal shootings by police. Some 25 percent of the entries have no race listed.

In any case, the numbers are misleading. “Based on that data, Mr. Moskos reported that roughly 49 percent of those killed by officers from May 2013 to April 2015 were white, while 30 percent were black,” the Washington Times article said. “He also found that 19 percent were Hispanic.”

That may be true, but whites make up 63 percent of the population of this country. Blacks are just 12 percent.

When Mr. Moskos adjusted his data to account for that, he found that black men were 3.5 times more likely to be killed by cops than white men. That’s inconvenient.

So Mr. Moskos did what other deniers of reality on this issue do: He larded into the results data on the homicide rate among African Americans, and then proclaimed that if you take that data into account, whites are at higher risk than blacks.

A fairer analysis, at ProPublica, found that black males aged 15 to 19 were 21 times more likely to be killed by police than white males in that age group. And The Washington Post reports that unarmed black men were seven times more likely to be killed by police this year than unarmed white men.
