EXCLUSIVE: Border Patrol Using Rare ‘Parole’ Exemption to Quickly Release Tens of Thousands of Illegal Aliens Into US​


DEL RIO, Texas—U.S. Border Patrol has started to use, on a mass scale, a special “parole” exception that was previously used sparingly to allow tens of thousands of illegal immigrants to stay in the United States for at least a year, The Epoch Times has learned.
Under parole status, illegal immigrants don’t have to provide Border Patrol with evidence of credible fear for asylum and are permitted entry without any preconditions, except a quick background check in the U.S. crime database.
A Customs and Border Protection spokesman said the parole designation allows for overwhelmed Border Patrol stations to process large numbers of illegal aliens “significantly faster” and release them into the country much faster than the more involved current system—which releases an illegal alien with a notice to appear that includes a court date for their first immigration hearing.
Parole should be a “very, very boutique thing,” said Andrew Arthur, resident fellow in law and policy at Center for Immigration Studies and a retired immigration judge.
“This is the exact opposite of what Congress said. This is a misuse and abuse of that immigration authority that borders on malfeasance,” he said.
Through the 1952 Immigration and Nationality Act (INA), Congress mandated that all inadmissible and illegal aliens be detained until their status is determined, after which they are either deported or granted entry with a legal status.
Parole is an exception and, although it’s not a legal status, it permits entry on “a case-by-case basis” for “urgent humanitarian reasons or significant public benefit,” according to the INA.

Americans are “bracing” for the Biden administration to end the Trump-era Title 42 at the southern border, which allowed agents to more easily turn illegal immigrants away. Last week, a federal judge in Louisiana extended the temporary restraining order preventing the Biden administration from ending the rule.

Trump Judge Will Not Dismiss Lawsuit Against Biden's Mass Release of Migrants​


A Trump-appointed federal judge denied a request from the Department of Homeland Security (DHS) to dismiss a lawsuit against the Biden administration for its catch and release policy, which has allowed hundreds of thousands of illegal immigrants into the country since January of last year.

Judge T. Kent Wetherell II refused to dismiss the suit, writing that laws "clearly and unambiguously state that aliens arriving at the border 'shall be detained,' not that they may be detained," and that "the cited provisions of §1225 expressly require aliens to be detained until removal proceedings have concluded, and that §1182(d)(5)(A) does not authorize Defendants to circumvent the mandatory detention requirement as it is allegedly doing through the challenged policies."

Florida Attorney General Ashley Moody sued Biden's DHS in February, stating that the agency was surpassing its authority by mass releasing illegal aliens and border crossers into the interior of the U.S., which then put an undue burden on states.

The case is Florida v. United States, No. 3:21-cv-01066 in the U.S. District Court for the Northern District of Florida.

The Biden administration released approximately 836,000 border crossers and illegal aliens into the U.S. interior from February 2021 to March 2022.

Senate and House Still Awaiting Response to their Demand for Missing ICE Data​

Members of Congress seek enforcement data for FY 2021 covered up by Biden administration​


The Biden administration’s troubling decision to not publish U.S. Immigration and Customs Enforcement’s annual “Enforcement and Removal Operations Report” — which the agency has published by December for at least the last decade — remains a significant and unresolved assault on government transparency. Two letters from Capitol Hill — one from Sen. Ted Cruz (R-Texas) and one written by Rep. Chip Roy (R-Texas) and signed by a total of 20 members of the House of Representatives — demand that the Department of Homeland Security (DHS) release the data contained in the missing report. The deadlines included in those letters have since passed; Cruz sought a response by March 5 while the House members requested a response by April 28. Sources tell me that ICE is actively assembling at least some of the data, a sign that the data may be forthcoming. The letters are republished, below.

DHS Secretary Alejandro Mayorkas’s decision to hide this critical data on ICE arrests, detention, removals, detainers, and alien criminality, is a strong sign that the policies the Biden administration has put in place .
