Actually, the Supreme Court ruled that a President can proactively pardon any federal crime that has been committed by anyone for any reason whether the crime has been charged or not.

If this wasn't the way it worked, then no one would get charged for a federal crime until after the President was out of office, if the prosecutor suspected that they might get a pardon from the President, which would render the Presidential power effectively moot.

Like Chevron Deference and Roe V Wade, it could be over turned (previous supreme court rulings) because they were legally wrong. They can't assume corruption in the ruling, in general. Of course they seem to do it all the time.
