I don't know why suing anyone needed to be resorted to in this case, but if these women really do need accurate birth certificates for the above reasons no one has any right to deny them that. It's not just a matter of title, but a matter of finances and education for their children.

But litigation seems a bit extreme. Why didn't a few phone calls do the trick?

Apparently they haven't been able to get anywhere with DHHS.

The lawsuit states that DHHS has entered the names of same-sex couples on birth certificates issued since May 13, when the U.S. Supreme Court struck down all state laws barring gay marriage. The Weisses have applied to have their sons' birth certificates amended but have received no response from DHHS, according to the suit.

Last time I checked, heterosexual infertile parents that adopt a child are still parents, regardless of sexual orientation. Are you saying that only people that are fertile AND straight can be parents?
