Kim Davis Supporters Demand Dept. Clerks be Fired

This was never about "religious liberty"

Kim Davis' supporters, in the wake of her release from custody, are now trying to push the issue even further. They are demanding that deputy clerks who issued same-sex marriage licenses, be fired immediately for "breaking the law." [Of course, Davis is the one who actually failed to comply with a court order and broke the law herself.

Exactly. This is about right-wing Christians just not liking gays.

how absurd and hypocritical

If you knew anything about the law, you would realize that the KY law, which has not been changed, defines marriage as man and woman

it is the Sup Ct that violated US Constitution.

10th Amendment

Sup Ct had NO jurisdiction to do what they did

I don't understand. Didn't the judge order them to take an oath to fulfil their duty of granting licenses?
How could they be fired?

Its a violation of Kentucky state law to alter the licenses and remove the name of the clerk who in the state law is the one who "authorizes" the licenses, even when a deputy clerk signs off on them.

The legislature hasnt met yet on it and the judge himself who ordered them (the deputy clerks) to issue them that way, under threat of them being in contempt, says he isnt saying whether it is or isnt legal)

On Friday morning, Davis woke up in jail and couples began getting marriage licenses in Rowan County for the first time since the Supreme Court ruled that Kentucky’s ban on same-sex couples’ marriages is unconstitutional. While both of those decisions might ultimately be correct, there is, as of now, no written explanation for why either of those things is happening — and at least one of them rested on shaky legal ground that could come back to hurt the couples marrying on Friday, a fact acknowledged by Bunning on Thursday.

Although five of Davis’s deputies have stated that they would issue marriage licenses, at least two — through their lawyers — questioned whether they would have the authority to do so.

“Whether a license issued by the Rowan County Clerk’s Office is valid or not,” Bunning said in court, “I am not saying it is or it isn’t.

He admits he doesnt know.

Here is what has been altered:

Copies of licenses issued to three of the couples who sued Davis, which were included in the court record, show that where Davis' name ordinarily would be, the words "Rowan County" were used instead. So instead of the forms saying they were issued on a certain date "in the office of Kim Davis, Rowan County County Clerk," which would be standard, the examples included in the court file say the licenses were issued "in the office of Rowan County, Rowan County County Clerk."

And another :

Kim Davis' lawyers also called into question whether any licenses issued in her absence would be legal.

But Bunning said couples will have to decide whether to take that risk on their own.

He does this but admits he doesnt know if they will be considered legal or not.

OK, thank you. Then it sounds like there is a lot of altering and deciding left to do.

According to who? The county attorney, the Kentucky attorney general, and the Governor all have said the changes are legal. The only one's who have said otherwise are Davis and her attorney. But given that they've been wrong on everything else in this case so far, their opinions don't carry much weight.

the judge himself who ordered them (the deputy clerks) to issue them that way, under threat of them being in contempt,

Except he didn't, and you can't stop lying about it.

says he isnt saying whether it is or isnt legal

Because that's not his call. That's a question for a Kentucky state court and would have to begin with someone objecting to the changes.
