Well said! An analogy I sometimes use is that if I am hunting and I see and hear rustling in a nearby bush, and I can't tell whether it is a deer or a person or something else, the burden of proof that the rustle is from a person is not on my hunting buddy or the game warden or anyone else. I should not shoot at the bush. If I do shoot at the bush I am fully responsible for any injury I might cause.
